These Terms of Use (“Terms”) govern your access to and use of the website kahanabaler.com (the “Site”) and your booking of accommodations, stays, classes, retreats, food and beverage, and related services (collectively, the “Services”) offered by Kahana Baler (“Kahana,” “we,” “us,” or “our”), a bed and breakfast located in Cemento, Barangay Zabali, Baler, Aurora, Philippines. By accessing the Site or booking with us, you agree to these Terms. If you do not agree, please do not use the Site or our Services.
1. Bookings and Reservations
All reservations are subject to availability and confirmation by Kahana. A reservation is confirmed only once you receive a written booking confirmation from us and any required payment or deposit has been received. You are responsible for providing accurate guest information at the time of booking. The minimum check-in age is 18 years.
2. Rates, Fees, and Payment
Room rates and the prices of classes, retreats, and other Services are displayed in Philippine Pesos (₱) and may change without notice until a booking is confirmed. The rate confirmed at the time of booking is the rate that applies to your stay. Applicable taxes and fees, where indicated, are added to the quoted price. Accepted payment methods and any deposit requirements are presented during checkout and in your booking confirmation.
3. Cancellations, Changes, and Refunds
Cancellation, date-change, and refund terms are provided in your booking confirmation and in our House Policies. Please review them carefully before booking. To request a cancellation or change, contact us at reservations@kahanabaler.com as early as possible.
4. Check-In and House Conduct
Check-in is from 2:00 PM and check-out is by 11:00 AM, unless otherwise agreed in writing. Guests agree to follow our House Policies, to respect other guests, staff, neighbours, and the surrounding environment, and to use the property and its facilities responsibly. We reserve the right to refuse service or require a guest to leave, without refund, for conduct that is unsafe, unlawful, or seriously disruptive to others.
5. Activities and Assumption of Risk
Surfing, swimming, yoga, hiking, and other activities available at or arranged through Kahana involve inherent risks, including the risk of injury. You take part voluntarily and at your own risk, and you are responsible for assessing your own ability and the prevailing conditions. The ocean, reef, and swimming pool are used at your own risk, and supervision is not provided unless explicitly stated. We strongly recommend that guests carry appropriate travel and medical insurance.
6. Damage and Liability
Guests are responsible for any loss or damage to the property or its contents caused by them or members of their party. To the fullest extent permitted by law, Kahana is not liable for any indirect or consequential loss, or for loss of or damage to personal belongings, except where such loss results directly from our negligence.
7. Intellectual Property
All content on the Site — including text, photographs, graphics, logos, and the “Kahana” name and branding — is owned by or licensed to Kahana Baler and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use this content for commercial purposes without our prior written permission.
8. Third-Party Links and Services
The Site may contain links to third-party websites or services, such as payment providers and booking tools, that we do not control. We are not responsible for the content, policies, or practices of any third party.
9. Privacy
Your use of the Site and our Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.
10. Changes to These Terms
We may update these Terms from time to time. The version posted on this page, with its stated “Last updated” date, is the version that applies. Continued use of the Site or our Services after changes are posted constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of the Republic of the Philippines. Any dispute arising from these Terms or from your use of the Site or Services is subject to the exclusive jurisdiction of the competent courts of Aurora Province, Philippines.
